Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)The hazard of being caught between equipment, in that employees at the CTSI warehouse were attempting to bend the exhaust pipe over while standing on the hood of the Case 580E Backhoe while the backhoe was running, in gear, bucket raised, and the brakes not set, exposing employees to the hazard of being caught between the backhoe canopy and the container top. Among other methods, one feasible method of abatement to correct this hazard is to turn off the backhoe, set the brake and place the transmission in the neutral position.
