Section 5(a)(1) of the Occupational Safety and Health Act of 1970: On or about 12/7/89, the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falling and crushing due to inadequately guarded hoistway landing opening and open hoistway shaft which could result in fatal or serious bodily injuries: a) On or about 12/7/89, the material handling elevator shaft is not provided with a shaft enclosure to keep employees out when platform is on upper landing and hoistway landing opening door can be opened when elevator platform is not at the landing, exposing employees to a 15' foot drop to floor below (per ANSI/ASME A17.1-1981, paragraphs 101.1 (c),110.1,111.3(b)(2) and 11.3(b)(2).
