Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: employees were exposed to hazards associated with falls and overhead falling objects when critical components of a flying concrete form's support (two post shores acting as the supporting legs on two sides of one end of the table) were not reinstalled upon completion of the deck form's re-installation at a higher level in the building. One method to abate the hazard, among others, would be the modification of the design of the form to insure that instability is precluded by the incorporation of legs which fly as an integral part of the form, and observe the applicable provisions of ANSI A10.9-1983 for Form Design: Reference Paragraph 7.6.14 - (Flying Deck Forms) "The formwork equipment must be installed, used and maintained in compliance with the manufacturer's procedures".
