Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On and before May 11, 1988, at the Capital Bank Plaza Project, employee(s) were exposed to the hazard of being struck by or crushed while erecting concrete tilt slab panels adjacent to previously erected panels which were not anchored and braced properly. Particular concerns include the following hazards: 1) The minimum allowable skew angle of 5 degrees with braces set perpendicular (90 degrees) to a panel was exceeded. 2) Expansion bolts were used to anchor the braces to the panels: Wall brace inserts are required. 3) With panels of a cantilevered configuration the stiff leg supporting the over hand was attached to the panel with expansion bolts: Wall brace inserts are required. Among other methods, one feasible and acceptable method to abate these hazards is to follow the recommendations and requirements as provided by the bracing material manufacturer and supplier; as found in Burke Catalog No. 870 and to follow the blue print requirements (Print and Page No. PN-17; as furnished to the site).
