29 CFR 1926.651(j)(2): The employer does not protect each employee by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: (a) Peachmont Farms, Marburger Road, Evans City, PA 16033: The employer does not ensure that each employee working in a trench is protected by keeping excavated material at least two feet from the edge of the upstream right lateral trench. This violation was documented on March 30, 2015 at a site located at Peachmont Farms, Marburger Road, Evans City, PA where employees were working in a 13 foot deep trench where spoil material was placed within two feet of the edge of the trench. To abate this violation the employer must ensure that each employee in a trench is protected by keeping excavated material at least two feet from the edge. (b) Peachmont Farms, Marburger Road, Evans City, PA 16033: The employer does not ensure that each employee working in a trench is protected by keeping excavated material at least two feet from the edge of the upstream right lateral trench.
