Text For Citation: 01 Item/Group: 001 Hazard:
Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls: (a) On February 20, 2015, for an employee who sustained fatal injuries after falling from a Werner 6008 eight-foot step ladder while changing a light bulb from the top cap of the ladder at the Unison Bank facility located at 401 First Avenue South in Jamestown, North Dakota. Abatement Note: Among other methods, one feasible and acceptable means of abatement is to follow the guidelines set forth in ANSI-ASC A14.5-2007, American National Standard for Ladders - Portable Reinforced Plastic - Safety Requirements. Specifically, paragraph 9.3.2 which states: "...The user shall not step or stand higher than the step or rung indicated on the label marking the highest standing level of a ladder. The user shall not step or stand on: (1) A ladder top cap and the top step of a step or trestle ladder, or the bucket or pail shelf of a self supporting ladder..."
