Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that: (a)The employer failed to ensure that signal persons were used to warn drivers when it was not safe to back up. Signal persons were not used when large buses with limited visibility to the rear were backed up at night in a dimly lit area. The area contained employee pedestrians, was congested with other vehicles, and abutted utility poles and guy wires that supported high voltage overhead power lines. Employees were exposed to the hazards of being struck by and crushed between the buses, being struck by equipment damaged by the buses, or being electrocuted by high voltage lines dislodged by the buses. One acceptable and feasible method to correct this hazard is to ensure signal persons are used to warn drivers when it is not safe to back up. ABATEMENT VERIFICATION AND CERTIFICATION REQUIREDATION
