Section 5(a)1 of Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from not being restrained in a forklift in case of tipping and/or rollover: a)Expeditionary Fighting Vehicle and Amphibious Assault Vehicle located west of Camp Pendleton: A forklift operator did not wear his seatbelt while operating the Yale Diesel Powered #5593 forklift in a high vehicular traffic area which may result in serious injuries. Employee was transporting equipment and materials related to the maintenance and service of Amphibious Assault Vehicles. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the operator manual under use of seatbelt: Always wear seatbelt while operating the machine to reduce the risk of personal injuries.
