Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized that were causing or likely to cause health or serious physical harm to employees in that employees were exposed to the hazard of being struck by locomotive engines and or related railroad equipment: a) At the north plant on June 27, 1989, the employer knowingly allowed and/or required employees to operate locomotive number 1258 with a defective braking system and did not remove it from service until proper inspection, evaluation and adequate repairs were completed by a qualified competent person. A feasible method, among others, to abate this hazard would be to remove locomotives with known malfunctioning and defective braking systems from service until equipment repairs have been completed and determined safe for operation by a qualified competent person.
