5(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. On and prior to March 15, 1994, employees at Marshall Ford, 6200 Mayfield Road., Mayfield Heights, Ohio, were subjected to the hazards of either being struck by a raised automotive lift and/or vehicle, or being caught between the lift and/or vehicle and the floor, resulting in fractures, crushed body parts, multiple internal injuries, and/or death. Inadvertent activities or movements of the hydraulic lifts were more likely due to lack of, or deficiencies in, safety equipment and procedures as specified in the National Standard Safety Requirements of Construction, Care, and Use of Automobile Lifts, ANSI B-153.1-1981. Among other methods, one feasible and acceptable method to correct the hazard is to comply with ANSI B-153.1-1981, along with the use of equipment designed in the industry to meet these standards. Deficiencies noted were as follows: A. The service area had 12 lifts (in-ground single and dual lifting post, frame contact and driveon types) that were not equipped with automatic mechanical devices to hold the lift in the fully extended position as per 3.2.1 of ANSI B-153.1-1981. B. For all 12 automobile lifts on site, there was no regular maintenance scheduled per ANSI B-153.1.-1981, Section 6.1. Among other methods, one feasible and acceptable method to correct the hazard is to obtain an automatic mechanical device to hold the lift in the fully extended position, with a safety factor of not less than 3 based on the rated load capacity, and then to equip the lift with this device. Another feasible and acceptable method is to use jack-stands to support the lift in the fully extended position, with a safety factor of not less than 3 based on the rated load capacity. The safety stop is stipulated in paragraph 3.2.1 of the American national Standard Safety Requirements for Construction, Care, and Use of Automobile Lifts, ANSI B-153.1-1981.
