Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about September 13, 1994, employee(s) were exposed to the hazard of being struck by falling broken, dead, split, or snagged tree limbs while conducting logging operations due to no training provided to employees in hazard recognition and the inspection of trees to be fell and those trees in the surrounding area. One feasible and acceptable abatement method, among others, to correct this hazard is to remove dangerous broken, split, dead or snagged limbs in the vicinity of the work area prior to conducting the logging operation.
