Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: 29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operators and other employees from hazards created by: (a) In the forging department, during the extremely dangerous practice of placing a loose piece of metal on the die face of the forging hammer to assist in removing stuck forgins, or for any other reason, employees were exposed to the hazards of being struck by the flying metal parts that kicked back when struct by the forging hammer. Methods of abatement are, but not limited to: 1. Constructing a hand held metal stop to take the place of using a loose piece of metal on the die surface of the forging hammer. 2. Indent an impression into the die surface of the forging hammer. The impression and the end portion of the hand held metal stop shall have the same configuration to ensure a locking effect when joined together and also to prevent kick-back when struck by the forging hammer. 3. Train all affected employees in the proper method of removing stuck forgings and periodically retrain employees.
