Text For Citation: 01 Item/Group: 001 Hazard: UNAPOPPROC
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Employees were exposed to the hazards of being thrown or ejected from the package delivery vehicles while the vehicle was used to transport more people than the vehicle was designed to accomodate in that adequate seating capacity and appropriate restraining devices, such as seat belts, were not provided and used at all times the vehicle was in motion by all passengers in the vehicle. Among other mothods, one feasible and acceptable method to correct this hazard is to provide a sufficient number of seats and appropriate restraining devices to accomodate all passengers in the vehicle, or in the alternative, restrict the number of passengers to the designed passenger capacity of the vehicle.
