Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about June 12, 1990 at 2911 Sutton Rd., Yellow Springs, Ohio, employee(s) were exposed to the hazard of being struck by falling dead, broken, split or snagged tree limbs while conducting logging operations. One feasible and acceptable abatement method, among others, to correct this hazard is to remove dangerous broken, split or snagged limbs in the vicinity of the work area prior to conducting the logging operation.
