OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by vehicles due to inadequate illumination. (a) 3040 Veterans Memorial Highway, Bohemia, NY (Worksite), Bohemia Yard Employees walking and working in the yard areas of the facility were exposed to being struck by vans and buses due to inadequate illumination. Direct reading illumination levels ranged between 0 and 10.6 foot candles (fc) / (0 to 114.1 lux (lx), throughout the yard areas on, or about March 13, 2015. Note: In addition to abatement certification, the employer is required to submit abatement documentation for this violation, in accordance with 29 CFR 1903.19. Failure to comply may result in an additional penalty of $1,000.
