Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing of likely to cause death or serious physical harm to employees in that employees were exposed to: Cleaning personnel engaged in the cleaning of health care facilities were exposed to the hazard of being infected by HBV and/or HIV through direct contact with possible infectious materials. Feasible and useful methods to control this hazard includes but is not limited to: 1) Identify employees at substantial risk and address circumstances warranting offering Hepatitis B vaccinations. 2) Provide adequate training to those high risk employees in areas such as precautionary measures, proper protective equipment, work practices, and modes of transmission. 3) Establish follow-up procedures after possible exposure in accordance with standard medical practices and CDC guidelines.
