Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling from an improvised ladder and/or framework of the separator used to gain access to material, when separating and bagging nuts in the warehouse area: Among other methods, on feasible and acceptable abatement method to correct this hazard is to provide a rolling ladder stand, of adequate height, to allow employees to work safely at both. The 4' and 8' levels adjacent to the separator machine.
