Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards: a) Chertok's Furniture - Employees did not receive instructions and training in the safe use and operation of the North 2nd Street Warehouse freight elevator. On October 30, 1996 an employee was fatally injured as a result of attempting to exit the elevator while it was moving. The employee got wedged between the freight elevator car floor and the hoistway wall. ABATEMENT NOTE: A Feasible an acceptable means of abatement would be that the employer adopt definite operating rules, post the rules in the elevator car, and require operators to know and observe the rules including but not necessarily limited to the following: 1. That only individuals that have been trained on the safe use and operation of the subject elevator be allowed to ride in the freight elevator car. 2. That the freight elevator only be loaded with furnishings and materials that can safely fit into the elevator without creating a hazard to the operator. 3. That the operator keep all body parts inside of the elevator car at all times while the elevator is in motion.r
