Section 5(a)(1) of the Occupational Safety and Health Act of 1970; The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to burns from lightening. a) Employees work on Screening Tower A and are protected from lightening strikes by air terminals on each corner of the upper structure. The terminal on the corner with the plastic Pink Flamingo has fallen so the terminals no longer provide the 100 foot zone of protection. Among other methods, one feasible and acceptable abatement method to correct this hazard is to reattach the existing air terminal in an upright position.
