Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard of approximately 10 feet from prohibited riding in the bucket of a case loader backhoe: a) Construction Worksite - Employee observed riding in the bucket of a Case 580 Super E loader backhoe, serial number unknown thereby exposing employee to a fall hazard of approximately 10 feet to the ground below, on or about July 14, 1992. Among other methods, one feasible and acceptable abatement method to correct this hazard is providing access by utilizing scaffolds, ladders and/or workplatform to gain access to second story of building.
