Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: A) Employees in building C operated a Wysong shear (Model No. 1010, Serial No. PB-212, Company No. 1011) to shear metal. No means was provided to protect the foot pedals from unintended actuation by falling on moving objects or by someone accidently stepping on them. The shear was last used on or about June 4, 1990.
