Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck/crushed by a falling load: a) On 8/16/91 a Robbins & Myers two ton electric hoist was used to lift the rear end of a Baker sit-down fork lift vehicle weighing approximately 9,718 lbs., thus overloading the hoist Among other methods, one feasible and acceptable abatement method is to use a forklift jack to do the lifting or another method is to use a hoist having sufficient capacity to lift the load.
