Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The hazard of being struck by falling loads in that a wire rope sling attached to the hook of a P & H Omega 40 ton Crane Serial #51718 was connected to two stake pockets on the front of the Fontaine Trailer #PTW 12980 which was loaded with approximately 40,000 pounds of precast concrete in order to lift the trailer so that the Kenworth W900 Tractor #674625 could be coupled. On or about 4-19-88. Among other methods, one feasible and acceptable method to correct this hazard is to use slings and/or attachments that are secured to the load in a manner which ensures proper lifting capacity and control.
