Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries resulting from fork truck tip over accidents: WORKPLACE: THE EMPLOYER FAILED TO REQUIRE EMPLOYEES TO USE SEAT BELTS THAT WERE PROVIDED ON THE HYSTER MODEL E30XL FORK TRUCK, SERIAL NUMBER C114V-08247-S. USE OF SEAT BELTS ON FORK TRUCKS WOULD SIGNIFICANTLY REDUCE OPERATOR INJURIES IN TIP OVER ACCIDENTS. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD WOULD BE TO REQUIRE THE USE OF SEAT BELTS THAT WERE PROVIDED ON THE FORK TRUCK." ABATEMENT CERTIFICATION IS NOT REQUIRED FOR THIS VIOLATION
