Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that engineering depart- ment workers including, but not limited to, incinerator operators were not adequately protected from potential infections of HBV and/or HIV through possible direct contact with blood or other body fluids: ESTABLISHMENT: ENGINEERING DEPARTMENT WORKERS INCLUDING, BUT NOT LIMITED TO, INCINERATOR OPERATORS WERE EXPOSED TO THE HAZARD OF BEING INFECTED BY HBV AND/OR HIV THROUGH POSSIBLE DIRECT CONTACT WITH BLOOD OR OTHER BODY FLUIDS WHEN HANDLING INFECTIOUS WASTE BAGS AND SHARPS CONTAINERS. THE EMPLOYER DID NOT ENSURE THAT EMPLOYEES IN THE PREVIOUSLY MENTIONED AREAS/DEPARTMENTS WERE OFFERED THE HEPATITIS B VACCINE TO THEM FREE OF CHARGE. A FEASIBLE AND USEFUL ABATEMENT METHOD FOR REDUCING THIS HAZARD, AMONG OTHERS, IS TO PROVIDE THE HEPATITIS VACCINE AT NO CHARGE AND IN THE AMOUNTS AND TIME PRESCRIBED BY GOOD MEDICAL PRACTICE TO THE EMPLOYEES WHO ARE POTENTIALLY EXPOSED TO BLOOD AND/OR BODY FLUIDS.
