Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: THE ROTATING SUPERSTRUCTURE OF THE SITE MOBILE OPERATING JOHN DEERE ELC EXCAVATOR ENGAGED IN MOVING BUNDLES OF METAL DECK FROM ONE LOCATION TO ANOTHER. AMONG OTHER ACCEPTABLE METHODS OF ABATEMENT ONE FEASIBLE AND ACCEPTABLE METHOD OF ABATEMENT IS TO PLACE THREE DECALS ON THE COUNTERWEIGHT OF THE EXCAVATOR WARNING OF THE DANGERS OF THE SWING RADIUS AND ALSO TO INSTRUCT WORKERS IN THE AREA OF THE HAZARDS ASSOCIATED WITH WORKING NEAR EXCAVATORS IN OPERATION.
