Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing and/or amputation hazard: (a) For employees working in the vicinity of the final cant belt conveyor and exposed to the potential for injury created by exposure to the unguarded moving belt on the underside of the conveyor. Among other methods, one feasible and acceptable abatement method is to place a guard on the underside of the conveyor to eliminate employee exposure to the moving belt as referenced in ANSI B20.1-1972, Safety Standards for Conveyors and Related Equipment Part 5.14.2 General Requirements; Paragraph 5.14.2.1 Moving Machine Parts that states: All moving machine parts shall, if feasible, be guarded. They may be guarded by their nature, in that they are intrinsically safe, as the pan of a housed-en-masse conveyor. They may be guarded by location, as is the piston of an internal combustion engine, or the head pulley of a belt conveyor stacker. They may be guarded by shield guards, trough guards or railing guards. In particular, all nip and shear points shall be guarded.
