Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to injury from the operation of an unsafe motor vehicle. Among other methods, one feasible and acceptable abatement method to correct this hazard is to develop and implement a more effective vehicle maintenance program which will reduce the likelihood of serious injury due to mechanical or other defects: At the Worksite - On or about 11/1/89, International Tractor #314 and Great Dane Trailer #T-79 (Reg. #R2515B ME) were not maintained in safe condition. (Ref. Maine State Police report #39216 dated 12/6/89).
