Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)Maintenance Shop, Beaumont - Hazard of being struck by shattered P. V. C. pipe which is installed above ground and is not constructed of or encased in shatter resistant material, approximately 150 PSI of compressed air was applied to pipe. Feasible abatement method includes but is not limited to: 1)Replacing all P. V. C. pipe above ground, used for compressed air transportation, with black iron pipe.
