Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to inadvertent activation of a tomato elevator while performing maintenance or repairs: On or about August 22, 1987, employees were maintaining or repairing the #4 tomato elevator while electrical energy to the motor was not effectively locked out, exposing employees to death or crushing injuries. Among other methods, one feasible and acceptable abatement method to correct this hazard is to fully emplement and enforce the lockout procedures contained in the employer's Loss Prevention Program dated August 1, 1975, and to ensure that all employees are trained and familiar with said procedures and supplied with necessary locks and tags before being permitted to perform maintenance, repair, or adjustment of machines and equipment capable of causing injury by unintended movement or energization.
