Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Crushing injuries and death as a result of being required to drive self-propelled vehicles or equipment on an elevated roadway which was not provided with a berm or guard on the outer bank. On or about June 25,1987, an employee was operating the Trojan Model 204-A rubber-tired loader, (Ser. No. 64-1733) on the elevated roadway which was located adjacent to plant No. 6 and parallel to the unprotected edge of the pit in which Plant No. 3 was located, the depth of which exceeded fifteen feet. Among other methods, one feasible and acceptable abatement method to correct this hazard is to install a berm or barrier guard on the outer bank of all elevated roadways. Such barriers shall be at least as high as the radius of the largest tire used on the roadway and of such design and construction as to prevent vehicle wheels from approaching the edge of the embankment.
