Text For Citation: 01 Item/Group: 001 Hazard:
Section 5(a)(l) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, including severe burns, to employees in that employees were exposed to dust explosion, deflagration, or other fire hazards from dust collectors being located inside a building and ineffective dust collection and fire protection systems: a) Saw & Grinding Rooms - Each of these rooms, located within the building, had a dust collector (after filter baghouse) having a volume capacity of greater than 8 ft.3 (0.2 m3); b) Saw & Grinding Area Dust Collection System - The interior of the duct collecting dust generated by sawing at CNC Saw No. 2 was not clean and free of residual material; and, changes in duct sizes along this duct length were not designed by utilizing a tapered transformation piece with the included angle of the taper not more than 30 degrees; c) Saw & Grinding Area and Laminating & Manufacturing (L&M) Area Dust Collection Systems - These systems had dust collection drums connected to baghouse after filters that were not airtight; d) Saw & Grinding Area and Laminating Area & Manufacturing (L&M) Area Dust Collection Systems - These systems were not equipped with fire protection equipment such as, but not limited to, spark / ember detection equipment; e) Laminating & Manufacturing (L&M) Area Dust Collection System - The pressure relief panels for this baghouse were blanked off. Conditions observed on or about January 14, 2015 and dates prior and since. Pursuant to 29 CFR 1903.19, the employer must submit abatement certification and documentation, required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
