Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling or being thrown from a moving vehicle. Two employees were riding on a Belroc Bobcat in the parking lot on the north side of the construction site. One employee was standing on a step on the side, and holding on to the rollover protective structure of the Bobcot, on or about 8/11/87. Among other methods, one feasible and acceptable abatement method to correct this hazard is to restrict the number of employees allowed to ride on a vehicle to the number of seats with seat belts provided on the vehicle.
