Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) In the maintenance department employees were exposed to the hazards of working under suspended loads on a Thern Lever Hoist subjecting them to the hazards of being struck and/or crushed. This unsafe condition subjected them to serious personal injury and/or death. Among other methods, one feasible and acceptable method to correct this hazard is, but not limited to: Elevate the forklift truck to the desired height so the necessary work may be performed safely. Ensure that the forklift is stable by using blocks, wedges, wheel chocks and cribbage to shore it safely in such a manner as to prevent slippage in the event of malfunction of the elevating equipment.
