Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about January 5, 1993 employee(s) working in the manhole at the intersection of Main and Monument St. in Dayton, Oh. were exposed to the hazards of potential oxygen deficient atmosphere or atmosphere(s) contaminated with combustible or toxic gases when they entered and worked in the manhole. One feasible and acceptable method to correct this hazard is the implementation of an effective confined space entry procedure which requires testing for a safe atmosphere prior to and during entry. The minimum requirements for confined space entry are contained in 29 CFR 1910.146 which becomes effective April 15, 1993.
