Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free free recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injury or death: a) On or about December 3, 1986, employees were required to catch and stop the pipe being loaded on the flatbed trailers from a forklift. The trailers were not equipped with stakes or side boards, nor was the pipe strapped or banded. Among other methods, one feasible and effective method to abate this hazard is protecting employees against shifting or falling cargo by requiring vehicles to have sides, side boards, or stakes when the material being loaded is not strapped or banded. Those devices must be strong enough and high enough to assure that the cargo will not shift or fall from the vehicle.
