29 CFR 1926.20(b)(3): The use of any machinery, tool, material, or equipment which was not in compliance with any applicable requirement of this part was not prohibited. Such machine, tool, material, or equipment was not either identified as unsafe by tagging or locking the controls to render them inoperable or by physically removed from the project: Inside the structure under construction: A JLG scissor lift, model number 2646E2, was not identified as unsafe by tagging or locking the controls, and it was not removed from the project. Employees that used the ladder to access the lift were exposed to the hazard of slipping off the ladder and falling onto to the metal corners of the lift. In the event of control failure, employees in the lift were exposed to the hazard of being caught between the lift and other objects, and employees around the lift were exposed to the hazard of being struck by the lift
