Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Hazard of being struck by vehicular traffic while working on January 25, 1990 near company truck parked in the south bound lane of Mississippi Highway 27 or about 4 miles south of Utica, Ms in that adequate advance traffic control devices were not provided due to the improper positioning of sign(s) and cone(s), and flagman not properly attired and positioned to control traffic in the work area. Among other methods, one feasible and acceptable abatement method is to insure correct placement of warning signs, cones and flagmen. The flagmen shall be provided orange vest(s) and orange flag(s).
