Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employer allowed the operation of a lift to occur that created a gross overload of the employee occupied derrick causing the derrick to overturn and the drowning of an employee. a) "IVO Port of Wilmington  On December 02, 2014, the employer allowed the retrieval operation of a anchor cable to proceed as a non-critical lift using a derrick to lift the cable, which was a submerged load. This lift operation resulted in exposing employees to a gross overload condition of the derrick causing the derrick to overturn, resulting in the drowning death of one employee."
