Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that Packing Department employees were exposed to: the hazard of undue cumulative trauma disorders to include Carpal Tunnel Syndrome caused by the highly repetitive bending, twisting of the wrist, the gripping and pinching with the fingers and making forceful exertions while packing candy into boxes from a conveyor line; while the ultimate responsibility is the employer's; among other methods, a feasible and acceptable abatement method of correction includes but is not limited to: a) Administrative Controls b) Rotation of work stations c) The institution of a Formal Training and Awareness Program.
