Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of rotating concrete mixer paddles while having their body within a concrete mixing machine. A feasible and useful method to correct this hazard, among other methods is to lock out or block off with a padlock or similar device the main power disconnect switch or valve, or both, controlling its source of power or flow of material before any maintenance, inspection, cleaning, adjusting or servicing of the equipment (electrical, mechanical, pneumatic, etc.,) that requires entrance into or close contact with the machinery or equipment. a) Batch Plant: Employees were allowed to enter a Praschak Machine Co. concrete mixer without the mainpower disconnect switch locked out or blocked off with a padlock or other similar device to insure that the equipment could not be activated while the employee was within the mixer during the cleaning operation.
