Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Dropped loads - In that periodic inspections (at least annually of hooks, to detect cracks, were not conducted; nor were 125% load rating tests made and the results recorded, after extensive repair work on hoist unit. Among other methods, one feasible and acceptable abatement method to correct this hazard is to instigate periodic inspections of hooks using die penetrants, magnetic particle or other suitable crack detecting method and to assign a responsible person who will direct loadtesting and prepare a written report confirming the load rating of the system. These reports shall be placed on file where they will be readily available.
