Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a.)the hazards of working in a confined space, a 48 inch water pipe about 10 feet below ground, without evaluating the entry and exit points to determine the most effective methods and equipment to be utilized to enable employees to safely enter and exit the space and to provide for emergency rescue/retrieval. A feasible abatement method, among others, would be to attach the entrant by a harness and lifeline to a winch or other device which would provide mechanical advantage to enable an attendant to remove the entrant from the confined space.ed
