Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck or crushed by a suspended load due to the lifting system being overloaded. a) Shipping and Receiving - Budget Hoist, support system, and trolley were not proof tested and marked to indicate its capacity. Among other methods, one feasible and acceptable abatement method would be to load test and rate the complete lifting system and operate within the rated capacity of the lifting system.
