OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to drowning hazards: a. On or about October 11, 2014 through October 14, 2104, located at the Discover Financial Services' north retention pond, employees performed surface-supplied diving operations using a Central Pneumatic air compressor that was not manufactured to produce Compressed Gas Association (CGA) Grade D breathable air to the divers, thereby exposing the divers to contaminated air and a drowning hazard.
