Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a striking hazard: a) Employees were exposed to a striking hazard in that on or about May 17, 1988, the Anderson Bale Opener, serial number 5510 located in the production area, was used to unbail mattress springs beyond its rated capacity. The original rating of the bale opener was 6500 pounds and the bale being opened at the time of the accident was approximately 8512 pounds.
