Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: Employees were exposed to the hazard of being struck by two (2) eight-inch diameter 20 ft. length of cast iron pipe, weighing 571 pounds each, and one (1) eight-inch diameter 40 ft. length of cast iron pipe weighing 1,142 pounds, during a chain-hoisting operation in which these pipes were hoisted in a prohibited manner, using the chain of the chain hoist as a sling, resulting in the slippage and falling of the 40 ft. length of pipe approximately eight feet to the basement floor. Among other methods, one feasible and acceptable abatement method to correct the hazard is to attach the load to the hook of the chain hoist by means of sling made of natural rope, synthetic fiber or wire rope and barricade the area under the load to make it inaccessible to employees. 590 5th ave., Basement, first and second floor, north area.
