Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The hazard of being crushed by equipment rollover while operating a D4 Caterpillar Dozer on uneven terrain on or about 12/08/91 and at times prior thereto at the Allen Johnson Ranch, approximately 4 miles N.E. of Deer Lodge,Montana. Feasible and acceptable abatement methods to correct this hazard are to install a Rollover Protective Structure (ROPS) on the equipment or limit equipment operation to terrain where a rollover hazard does not exist.
