Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) On or about 3/6/90 aprpoximately one mile east of Opportunity, Montana an employee was exposed to the hazard of being crushed by equipment rollover while performing earth moving operations on an approximate 30% grade with a Model 12-E Caterpillar motor grader, Serial No. 99E10162. Two feasible abatement methods, among others, to correct this hazard are to install a Rollover Protective Structure (ROPS) on the equipment or limit equipment operation to terrain where a rollover hazard does not exist.
