Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to burn hazards from hot asphalt in the event of tank rupture during filling from inadequate and/or clogged venting: a) Asphalt Storage Tank - 20,000 gallon above ground horizontal tank had inadequate emergency venting and the three (3) inch vent was clogged, May 2 and May 6, 1986. Among other methods, one feasible and acceptable method to correct the hazard is to install venting, meeting the requirements of UL 142, Section 10.3 Steel above ground tanks for flammable and combustible liquids and ensuring vents remain open.
